(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all services provided by TheHealthMentors-MOMENTUM (coaching & health consulting in 9053 Teufen, Switzerland) and TheHealthMentors OPTIMA (medical services and medical center in LINDAU, Germany). They also apply to all services provided by BiKo Health GmbH, based in 9053 Teufen, Switzerland.
(2) They govern the terms and conditions for coaching, online/offline consultations, medical treatments, online courses, webinars, seminars, and retreats.
(3) Deviating terms and conditions of the customer will not be accepted unless they have been expressly agreed in writing.
(4) If the individual agreements with the customer and the terms and conditions contain deviating provisions, the provisions of the individual agreement shall take precedence over those of the terms and conditions. However, if the provisions of the individual agreement are unclear or incomplete, the provisions of the terms and conditions shall apply.

(1) TheHealthMentors-MOMENTUM, based in 9053 Teufen, Switzerland, offers coaching, counseling, holistic body therapies, psychological-pedagogical interventions, consciousness-based therapies, mind-body alignment, and energetic treatment methods in general health promotion and specifically in the areas of functional medicine, epigenetics, high sensitivity, HPU, ADHD, autism, personality development, chronic complaints/pain symptoms, and exhaustion complaints for all age groups. These services serve the purpose of holistic health promotion and do not replace medical diagnosis or treatment.
(2) Coaching and counseling provided by TheHealthMentors-MOMENTUM do not constitute medical treatment, even if functional medicine is used as a basis. If medical clarification is required, referral to TheHealthMentors-OPTIMA or other physicians is recommended.
(3) TheHealthMentors-OPTIMA, based in Lindau, Germany, is a medical center that provides medical and therapeutic services. These include, among others:
• Functional diagnostics & laboratory analyses
• Infusion therapies
• Special detoxification therapies
• Intestinal restoration
• Nutritional counseling
• Lifestyle optimization
• Other medical and therapeutic treatments
• Medical support for patients with HPU, HPU children, ADHD, autism, chronic fatigue, pain syndromes, autoimmune diseases, unclear symptoms, and hormonal imbalances
• Individual therapy recommendations based on holistic medical findings, functional medicine, and conventional medicine

(1) Bookings for coaching, medical services, online courses, or retreats can be made via the website, email, or other written agreement.
(2) By making a booking, the customer agrees to these terms and conditions.
(3) After the booking has been received, the customer will receive a confirmation email containing all important information.
(4) Medical services can only be provided after a prior appointment has been made.

(1) Coaching and consulting services:
• Current prices for coaching, consulting, courses, body therapies, special energy therapies, other services, and retreats will be provided upon request and are specified in the offer upon conclusion of the contract.
• Payment is made in advance by bank transfer, PayPal, TWINT, credit card, or on site by card or cash. Cash payments must be made in exact change, as no change can be provided.
(2) Medical services:
• Medical services provided by TheHealthMentors-OPTIMA are billed in accordance with the German Scale of Medical Fees (GOÄ) and/or an individual agreement. Depending on the amount of work involved, a rate exceeding the GOÄ may be charged. Services that are not covered by health insurance must be paid for by the customer. There is no guarantee that your health insurance will cover the costs.
• Unfortunately, billing through statutory health insurance companies is not possible. Statutory insured persons must pay the invoice themselves (self-payers).
• Payment is made in advance by bank transfer, PayPal, TWINT, or credit card. If advance payment is not possible or the amount of the invoice cannot be determined in advance, the amount must be paid on site, either by card or in cash. Cash payments must be exact, as no change can be provided.
(3) Payment by installments & refunds:
• Payment by installments may be agreed for certain services. This must be agreed on an individual basis.

(1) Individual coaching & consulting:
• Cancellation up to 48 hours before the appointment: free cancellation or rescheduling
• Cancellation less than 48 hours in advance: 50% of the fee will be charged
• Cancellation less than 24 hours in advance: 80% of the fee will be charged
(2) Online courses & programs:
• After booking and receipt of payment, there is no right to a refund, as the content is available digitally.
(3) Retreats & live events:
• Cancellation up to 4 weeks before the start: 80% refund
• Cancellation up to 2 weeks before the start: 50% refund
• Cancellation less than 2 weeks in advance: no refund possible
(4) Medical appointments (e.g., diagnostics, therapies):
• Cancellations must be made at least 48 hours in advance.
• In case of no-show or short-term cancellation (less than 48 hours), a cancellation fee of 80% of the service will be charged.
(5) TheHealthMentors reserves the right to postpone or cancel appointments for important reasons (e.g., illness, unforeseen circumstances). In this case, an alternative appointment will be offered.

(1) For coaching & consulting:
• TheHealthMentors-MOMENTUM accepts no liability for health, physical, or financial damage resulting from the application of the content provided.
• Each customer is responsible for their own actions.
(2) For medical services:
• TheHealthMentors-OPTIMA provides services based on the best medical knowledge and current scientific findings.
• A cure or improvement cannot be guaranteed, as each person reacts individually to treatments.
• Patients undertake to provide complete and truthful information about their health.
(3) General:
• No liability is assumed for the success or failure of a treatment or coaching.

(1) All personal data will be treated confidentially and will not be passed on to third parties, unless there is a legal obligation to do so.
(2) In the case of medical treatment, TheHealthMentors-OPTIMA is subject to medical confidentiality.

(1) All materials provided in coaching or courses (PDFs, videos, workbooks, etc.) are subject to the copyright of TheHealthMentors.
(2) The distribution or reproduction of the materials is not permitted.

(1) Changes or additions to these terms and conditions must be made in writing.
(2) Should individual provisions be invalid, the validity of the remaining terms and conditions remains unaffected.
(3) The law of the country in which TheHealthMentors is based applies. The registered office of TheHealthMentors-MOMENTUM is in 9053 Teufen, Switzerland. The registered office of TheHealthMentors-OPTIMA is in Germany. The courts at the respective registered office (TheHealthMentors-MOMENTUM: 9053 Teufen; TheHealthMentors-OPTIMA: Lindau, Germany) shall have jurisdiction over any disputes arising from this contract.
